can he tested best on shipment here, are always the same, and no amount of analyses
and guarantees could in any way alter the quality, it only means that speculators
put so much extra on the price to compensate for the buying.
We note you write with regard to modification of clause 6. So far as we
are conserned we certainly would never enter into any contract under which we
were prevented from having any recourse to any Court of Law. ,
With regard to the Strike clauses, we really have nothing to say. It there
is a strike and the contractor has no coals to deliver, it is always considered in all
contracts in this country to absolve the Contractor from Deliveries1
By the wav, we hear that Owens Merthyr! is still on the list of coals the
Danish Railways are willing to accept! . which, if correct, shews how very much
out of toucli these railways must be with the conditions of our market, when a
speculator called Owen is able to pick up any coals on the Market call them Owens
Merthyr and impose them on the Danish Railways, who retain the name on then
list, apparently under the impression that it is a Colliery of importance, the same as
Bevnons or Nixons. 11
You will notice that the Italian State Railway which used to have very
severe conditions found that it did not pay and have now changed over to the modern
system of buying on Colliery Certificate and Dock weights and inspecting the coal
on shipment. In this way of course, coal is only bought under the name of the colliery
in which it is mined and not under fancy names such as Owens Merthyr. There
is no colliery of the name of Owen and the name Merthyr means nothing so that
Owens Merthyr is simply any coal that Owen likes to ship. Of course if the Railway
buy coal without naming the colliery from which it is to be drawn, then very severe
conditions would be necessary«.

Det vil vistnok forstaas, at intet Firma, der har nogen Respekt for sig selv
vil indgaa paa en Bestemmelse, som den i § 6, der fuldstændig giver Firmaet i Mod-
partens Vold, hvem saa end denne Modpart er, og en Bestemmelse der afskærer
Rekurs til Domstolene eller hvilken som helst anden upartisk Afgørelse, er navnlig
ogsaa saa uforenelig med engelske Begreber, at det ikke kan forbavse, at mine Klienter
vægre sig ved at indgaa derpaa. . 12 1
Hvad dernæst § 8 angaar, saa er det her som i Udlandet overalt Sædvane,
at Køberen bærer Risikoen for Striker og Lock-outer. Det ses imidlertid ikke af
Ordlyden af § 8, om det er Hensigten, at der ved Fastsættelsen af Pristillæg eller
Prisafslag for de substituerede Kul skal gaas ud fra Kontraktpreisen eller fra denne
med saadant Tillæg, som er foraarsaget ved Arbejdsstandsningen, idet Kulpriserne
i saadant Tilfælde sædvanlig stige betydeligt. I første Tilfælde vilde Leverandøren
komme til at bære Tabet, og dette er, som nævnt, i Strid med almindelig Sædvane.
Ligeledes indeholder § 8 i. f. en Bestemmelse, der ganske voldgiver Leverandøren
til Statsbanernes Bestemmelse. 1. 1
Jeg tillader mig derfor paa mine Klienters Vegne, avis Navn, om ønskes,
gerne skal blive opgivet, at henstille til behagelig Overvejelse, om der ikke ved frem-
tidige Licitationer kunde være Anledning til at ændre do nævnte Bestemmelser
i Betingelserne, saaledes at de bliver mere akeeptable for eventuelle Leverandorer.
