shall determine whether the Contractor shall be absolved from his risk and responsibility pursuant to
Section 9.
Within a fortnight after the completion of the work or the delivery the Contractor shall send in
a specification of all the claims he presumes to have against the Board of Work relative to this work or
delivery, after the sending in of which specification no further claim will be received.
The deposit mentioned under Section 16 will not be returned till the Contractor has made good
all his engagements.
4 19. Disputes.
All disputes between the Board of Work and the Contractor about their respective rights and
duties according to the contract or about the decisions of the Board of Work, shall be referred to the
Ministry for Iceland.
If the Contractor thinks himself prejudiced by the decision of the Ministry, the dispute may be
submitted to arbitration, still with the restrictions mentioned in the following paragraph.
The Contractor shall submit to the decision of the Ministry in all cases of dispute concerning
work or deliveries to an amount not exceeding 2000 kronur according to the estimate of the Board of
Work, or if the difference between the estimates of the parties does not exceed 1000 kronur; and he shall
submit to the judgment of the Board of Work as to the execution of the work and in case of disputes
relative to Section 7, 13 and 14. •
In case of arbitration either party shall appoint one arbitrator within 4 days. In case of either
party neglecting to appoint an arbitrator within the time fixed, the other party shall appoint both arbi-
trators. Before they proceed to arbitration, the arbitrators shall appoint an umpire. If the arbitra-
tors cannot come to an agreement as to the appointment of the umpire before the expiration of 8 days
from the day of their appointment, the umpire shall be appointed by the High Court of Justice of Iceland.
The parties shall submit to the award agreed on by the arbitrators. In case of non-agreement
of the arbitrators, the umpire shall have casting-vote. The expenses of the arbitration shall be determined
and apportioned between the parties by the arbitrators.
The Contractor shall continue to comply with the orders of the Board of Work until all disputes
have been settled, whether they are referred to the Ministry for Iceland, or to arbitration or to the tribunals.
In case of prosecution the Contractor or his guarantees (if any) shall appear before »gestarjettur
Reykjavikur« (an extraordinary session at Reykjavik) when summoned like persons domiciled within the
jurisdiction.
4 20. Tenders.
Besides the statements expressly required the Tenders shall contain the name, addresses and
signatures of the persons tendering. Several persons tendering in company shall be jointly and separate-
ly responsible. Additional clauses not expressly required or reservations may cause the Board of Work
to abolish the Tender and regard it as not made.
The Tenders will be opened at the time fixed and in the presence of those of the persons ten-
dering who shall appear. No Tenders will be received after the opening of the Tenders has begun.
The Board of Work do not bind themselves to accept the lowest or any Tender.
5 21. Contract.
When a Tender has been accepted, a special Contract shall be drawn upp. The stamp duty (if
any) shall be paid by the Contractor. Contracts concluded in Reykjavik are free of stamp duty.
All disputes between the contracting parties that may be referred to the tribunals for decision
shall be settled according to Icelandic law.
Copies of the Contract, descriptions, drawings &c shall be delivered to the Contractor, who shall
return the same after finishing the work.
No transfer of the Contract to any other persons shall be made except by the permission of the
Board of Work.
§ 22. Special Remarks.
Tenders marked on the outside: »Tenders for the construction of a Harbour at Reykjavik«, shall
be sent in sealed letters to: »The Town Council of Reykjavik« before August, 31, at noon.
Persons tendering shall abide by their offer for 45 days.
§ 23. The Board of Work.
The Board of Work shall be harbour commissioners elected by the Town Council of Reykjavik.
